faculty, come in, but this morning at 7:30 a.m., at least one teacher and we are told, three students, did spots the man in the backyard. >> and eighth grade teacher first spotted the naked body of the man at the school playground. we are told of these three young students alsoaw the murder victim. that is what is most upsetting to school parents and neighbors. >> i feel so -- i do not know what to say. >> the body lay in the schoolyard four hours this morning. we could see students from time to time picking out windows, but we are told it was made impossible for them to see the man. >> the hatchett block to the children could not access or see anything having to do with the forensic investigation. they moved him to the front of the building.

but the victim was a man in his 20's or early 30's. he appeared to be a victim of beating. in addition, his body had at least been partly set on fire, perhaps in an attempt to cover up evidence. they could tell enough from the crime scene to tell that this was no random act. >> we do not know why he was targeted, but he was targeted, more than likely in regards to the lifestyle he was leading. >> colonel davis would not define exactly what he meant by that comment. he said it could be any number of things, and gangs, drugs, selling and so forth. -- so on and so forth. we're told an investigation into this case is wide open. >> coming up, the event so big it is bringing the president of the first lady, and oprah to gear up accurate -- to europe.

>> the courtroom was packed, in fact, overflowing into the hallway. they testified straight to a judge and the judge made a decision all in the same day, the decision coming about an hour-and-a-half ago. we have been hearing from the family in the last hour. the bottom line, 18-year-old eggs a year pinckney has been convicted of two counts of capital murder. that requires him to be sentenced to two life sentences because he was a minor at the time of the crime. he is not eligible for the deh penalty. we learned a little bit more about what happened on december 19 in dale city. the suspect had already signed a confession. some details were not discussed. he found an unloaded gun in the smith family home. he then, and loaded the gun and shot a 19-road jane smith.

according to the -- james smith. -- 19 months old james smith. the suspect then in his own confession admitted that he left the premises, realized he forgot his jacket, came back, and that is when jean smith, james's mother, found her son's body. she was in the process of being on the phone calling for help when she was shot through the year. aording to his confession, pekingese says, and this was key to getting him capital murder, he was thinking, how my way to get out of this? he knew she recognized him and he reacted and shot her. >> the judge does not believe it was a reaction, but premeditated murder. after the guilty verdict, her husband and father of james smith, rick smith spoke to us.

>> this was obviously a tremendous step for us so that we could get some kind of justice for jean and jim. >> sentencing will be set for february 5. under current guidelines, the defendant has to be sentenced to two licenses. however, that issue is before the virginia -- to two life sentences. however, the issue is before the virginia supreme court. >> prince george's county police were searching for three masked man they believe broke into a home and killed the father inside. the suspects held at 39-year-old tyrone richardson's family at gunpoint. richardson suffered trauma to his upper body and was dead when officers survived -- not arrived. investigators -- when officers çarrived. investigators believe he was the target.

>> breaking news coming out of montgomery county. çpolice shot a man after he crashed into a yard in gaithersburg. >> this is the neighborhood. it is a beautiful neighborhood. this whole thing unfold about 3:30 p.m. this afternoon in montgomery county. the homeowner who lives in that house just behind me has red shutters. he looked out his window and saw a black cadillac driving of his long drive.

a man got out, strange man. the guy did not know him. the homeowner when out to check it out and said, what are you doing here. the man got back into his car and tried to turn around to flee. at that moment, the hoowner got suspicious, called police and police arrived. the guy was stuck in the mud. the suspects got out of his car and rushed toward the police officers to try to attack and charge. at that point, we're told the officer fired with his service revolver, shooting the suspect five times. >> at this point, and montgomery county police officer arrived. subject -- the subject got out of his vehicle and attacked the officer. the officer then shot his service revolver.

>> the county is asking the state's highest court to review the case of four on duty police officers who were caught driving over the limits by the speed cameras. a lower court ruled they did not have to pay the fines because there was no clear policy about it. but they should have to pay them just like we do. >> it would be reasonable if they had to respond to a call and had to be speeding, but if they were just going along normally, then it is reasonable to rule them accountable will we be told anyone else accountable. >> the attorney their present police officers issued this statement today, the county did not follow the law when it tried to transfer liability from itself to each individual officer as a driver. >> police officers do a lot and put up with a lot that we do not necessarily know about, so i am on the fence about it.
